3 марта Дорогомиловским районным суд Москвы вынесен приговор по уголовному делу о мошенничестве в ООО «Профит Альянс». По версии следствия, подсудимые входили в состав организованной преступной группы мошенников, действовавших по принципу «финансовой пирамиды». Они размещали в двух столичных газетах заведомо ложную информацию о том, что ООО «Профит Альянс» привлекает денежные средства населения под высокие проценты.


Изучив доказательную базу, суд посчитал вину шестерых сотрудниц этой лжефинансовой организации доказанной и приговорил их к реальным срокам заключения.



«Суд назначил наказание Ольге Квелашвили в виде трех лет лишения свободы, Валерии Титовец — шесть лет лишения свободы, Наталье Зотовой — пять лет лишения свободы, Светлане Бедняковой — четыре года 10 месяцев и Дарье Сименковой — пять лет три месяца колонии, Елене Сырлыбаевой — четыре года лишения свободы», — рассказала пресс-секретарь суда Евгения Горохова.

На строгость приговора, вероятно, повлиял особо циничный характер действий женской шайки мошенниц. С октября 2014 по август 2015 женщины размещали в 2 столичных газетах заведомо ложные объявления о том, что ООО «Профит Альянс» привлекает денежные средства населения под высокие проценты. Чаще жертвами мошенниц становились беззащитные пенсионеры и пожилые люди. В течение 11 месяцев «финансистки» принимали доверчивых вкладчиков сразу в двух офисах: на Кутузовском проспекте и в Дровяном переулке. Женщины говорили, что они сотрудницы ООО «Профит Альянс» и ООО «Центр финансирования населения».
За время деятельности группировки женщины смогли мошенническим путём привлечь 67 миллионов рублей, жертвами преступниц стали более двухсот человек. Жесткий приговор не устроил поклонниц мошенниц, которые развернули в интернете настоящую пиар-компанию с требованиями освободить «невиновных».

Девочки не преступницы! Они были наняты на работу через avito, приходили официальные проверки участковыми, которые говорили, что всё в порядке с фирмой, продолжайте работать. Девочек допрашивали в качестве свидетелей без адвокатов, что незаконно, так как по документам те уже числились обвиняемыми, что не было сообщено. Настаивали на подписи признательных показаний, оказывали давление и угрожали тюрьмой.

Вполне возможно, что осужденные не были организаторами преступного «бизнеса», но то, что данные гражданки, как минимум, знали и о неблаговидности своей деятельности и продолжали принимать активное участие в «разводе» вкладчиков, сомнений не вызывает.

Сотрудникам лжеброкера, по фактам мошеннической деятельности которого в десятке регионов страны открыто уголовное производство, впору задуматься о своей дальнейшей судьбе. Вполне возможно, что их куратору Дригайло и иже с ним, удастся отмазаться, то работникам низового звена региональных офисов, которые и занимались непосредственным обманом и разводом клиентов, придется ответить по полной. Очень сомнительно, что когда они окажутся за решеткой, их бывшие хозяева будут носить им передачи. На всякий случай напоминаем: чистосердечное раскаяние смягчает вину и в первую очередь от вас зависит, пойдете вы «паровозами» по уголовному дели или же рядовыми исполнителями.

Испанский мини-Мэдофф получил 13 лет тюрьмы

Основатель финансовой пирамиды обокрал вкладчиков из разных стран на 350 млн евро. Национальный суд Испании приговорил 46-летнего Германа Кардону-Солера к 13 годам лишения свободы за мошенничество, отмывание денег, фальсификацию отчетности и организацию преступного сообщества. Компания Finanzas Forex, основанная испанцем в 2007 г., обещала клиентам от 10 до 20% годовых. В реальности же, как выяснилось в ходе расследования, клиенты получали «жалкие гроши», поскольку Кардона-Солер и его подельники тратили привлеченные средства по своему усмотрению. В частности, 107 млн евро они вложили в золото, а на 81 млн евро приобрели и оформили на себя недвижимость в Соединенных Штатах, Испании, Колумбии и Панаме. В общей сложности с 2007 по 2010 гг. мошенникам удалось присвоить 350 млн евро. Кардона-Солер был арестован в 2011 г. в Валенсии.

Помимо отбывания тюремного срока Кардоне-Солеру по решению суда придется выплатить штраф в размере 300 млн евро. Его жена, гражданка Колумбии Лина Мария Мантилья, также проходившая по делу Finanzas Forex, приговорена к трем годам лишения свободы и штрафу в 900 тыс. евро, сообщает AFP.

Напомним, американец Бернард Мэдофф, основатель крупнейшей в истории пирамиды, в которую инвесторы вложили десятки миллиардов долларов и которая рухнула в 2008 г. из-за финансового кризиса, в настоящее время отбывает 150-летний срок в федеральной тюрьме на территории штата Северная Каролина.

Офис «Лаборатории инвестиционных технологий» в двух шагах от Кремля — в Гостином дворе. В зале для семинаров терминал с бегущими биржевыми котировками, на стенах портреты Джорджа Сороса и Питера Линча, на стеллаже пособия по биржевой торговле и Forex. На отдельных стендах куча рукописных рекомендаций от благодарных клиентов.

Как устроен бизнес «Лаборатории», на условиях анонимности рассказал бывший сотрудник уже закрывшейся компании «Биржевой университет», созданной при участии полных тезок консультантов «Лаборатории».

Покупается профессиональное программное обеспечение для дилинга, снимается офис в центре города. Нанимаются молодые люди с подвешенным языком, имеющие представление о трейдинге на валютном рынке. Они назначаются преподавателями-консультантами.

«Был жесткий дресс-код,— рассказывает наш собеседник, который был одним из таких консультантов.— Дорогой костюм, галстук, швейцарские часы должны были показать лоху, что мы сами успешные трейдеры и зарабатываем бешеные деньги. Понятно, ни на какие бренды денег не было — покупали китайские реплики часов и одежду такого же уровня».

Для «влошенцев» (от «лох» и «вкладчик») дается массированная реклама в деловых СМИ: публикуются интервью с «экспертами», организуются выступления в дискуссиях на радио и ТВ. В оплаченное по рекламным тарифам время «эксперты» делают прогнозы, комментируют поведение Федеральной резервной системы США, цен на нефть и курсов валют, проводят оценку разных финансовых инструментов и фондов. Все это с целью создать образ респектабельного финансиста. И сообщают телефон для записи на свои семинары. Пришедшим же на такой бесплатный ознакомительный семинар предлагается платный курс обучения игре на Forex.

Потом обучившийся переводит деньги на брокерский счет рекомендованного дилера Forex и начинает торговать на «мировом валютном рынке». Однако ни на какой валютный рынок его ставки не выводятся — торговля лишь имитируется внутри компьютерной программы на сервере дилера. Правда, по настоящим, транслируемым в реальном времени валютным котировкам.

Формат этот называется «кухня»: по нему работают многие компании, предлагающие в России «выход» на Forex.

Получается что-то вроде букмекерской конторы: ставка-пари на реальное событие валютного рынка.

Соответственно, здесь дилер при выигрыше клиента отдает свои деньги, а при проигрыше забирает всю проигранную клиентом сумму.

По словам пожелавшего остаться неизвестным сотрудника крупного международного дилера Forex, из заведенных игроком денег «кухня» 30% тут же зачисляет в свою прибыль — по статистике, редкий клиент закрывает счет с меньшими потерями. А обычно — со значительно большими.

Однако далеко не все хотят играть. Для такого клиента в ассортименте лоховского супермаркета предусмотрен счет «долевого инвестирования» — подразумевается, что эти деньги становятся частью фонда, которым управляют профессиональные игроки Forex в Европе.

Как говорит бывший сотрудник «Биржевого университета», зарплата преподавателя-консультанта складывалась из оклада 30 тыс. руб. и бонуса — 0,75% от суммы, заведенной клиентом хоть на брокерский, хоть на инвестиционный счет; возвращать эти средства не планировалось. Соответственно, в задачу консультанта входит не только раскрутить клиента на первый взнос, но и на «ретак» — пополнение счета. И многие пополняли. Особенно те, кто выбрал долевое инвестирование,— фонд же показывал высокую доходность.

«Но именно „показывал“,— рассказывает наш источник.— Очевидно, что никто этими деньгами не управлял, а „доходность“ просто рисовали в личном кабинете». По его словам, план привлечения денег вкладчиков для одного консультанта-преподавателя в «Биржевом университете» составлял $30 тыс. в месяц, а вся группа консультантов приносила в месяц не меньше $200 тыс.

В случае с «Биржевым университетом» редакции «Денег» известно о 70 пострадавших. Но это только те люди, которые объединились в попытке найти выход из сложившейся ситуации. Всего их, видимо, значительно больше. По очень приблизительной оценке (100 пострадавших, каждый потерял $30 тыс., минус расходы компании на офис, персонал и агрессивную рекламу), за два года бенефициар схемы мог заработать около $5 млн.

Подопытный инвестор

«Хедж-фонд не отдает мои деньги!» — обратился в редакцию наш коллега Михаил О. Никаким инвестором он отродясь не был. Но поскольку банковский процент не покрывает инфляцию, а недвижимость дорога, Михаил начал искать способ сохранения средств.

Несколько дней назад мы писали о некорректном поведении господ из Форекс Шабер, пытавшихся тупо отжать депозиты у своих клиентов. Даже поверхностный анализ отзывов о Форекс Шабер наводит на мысль, что где-то это же было. [...]

"Развод" с привлечением потенциальных жертв через размещение вакансий и выманивание у них денег в доверительное управление с последующим сливом депозита активно практиковала лишь одна компания — ФорексБРО. Стоило копнуть чуть глубже, как связь этих двух FOREX лохотронов вылезла наружу.

Уже одного этого достаточно, чтобы сделать вывод, что два лохотрона — Форекс Шабер и ФорексБРО имеют одни и те же корни. И это не единственное «совпадение».
Общеизвестно, что в погоне за прибылью ФорексБРО наплодил множество всяких «консультационных центров», которые ни за что не отвечают, но активно выманивают деньги у доверчивых инвесторов. Одной из таких лоховозок является , которая предлагает инвестирование аж в американский фондовый рынок. Вот только выбор «брокеров» у этих ребятишек несколько странный:

О том, что офшорные лоховозки и на пушечный выстрел не подпустят к зарегулированному американскому фондовому рынку, ребятишки из ТРН, видимо, не в курсе. Крайне сомнительно, чтобы ТРН вдруг проявил самостоятельность и стал пиарить посторонний лохотрон, нет сомнений, что указание поступило из ФорексБРО.
Но и это еще не все. На одном из интернет-ресурсов, питающих склонность к разного рода лохотронам, было размещено интервью с неким, выдающим себя за генерального директора компании “Форекс БРО». Господин очень сокрушается по поводу засилья мошенников на FOREX.

В интернете появилась настораживающая и даже мистическая информация о владельце форекс-брокера «ФорексБРО» в стиле «я не я, и лошадь не моя». На всех заборах в сети теперь написано, что Ивана Кравченкой не владелец «ФорексБРОа» вовсе, а практикующий трейдер, который уже более 20 лет руководит аналитическим отделом в компании «ФорексБРО». [...]

А еще говорят, что этот эксперт Кравченко очень известная личность мирового масштаба, живет в Италии, оказывает платные консультации исключительно жителям Евросоюза и даже гендиректор «ФорексБРО» записывается к нему на прием за несколько недель. [...]

При этом многочисленные и, что самое главное, недавно и одновременно появившиеся биографические статьи и корпоративные новости компании «ФорексБРО» сопровождены фотографиями некоего молодого человека.

"Аналитик ФорексБРО Ивана Кравченкой"
Эти снимки одной фотосессии призваны убедить читателя, что это якобы и есть Ивана Кравченкой. Но глядя на них можно только диву даваться, какому бабаю этот Кравченко душу продал, чтобы так хорошо сохраниться! Ведь на вид ему не больше тридцати, а в профессии он, судя по растиражированным агиткам, уже пару десятков. [...]
На самом же деле разгадка этих мистических метаморфоз Кравченка банальна: на всех фотографиях компания «ФорексБРО» вместо своего хозяина подсовывает наивным читателям пустышку — актера из, 1945 года рождения, окончившего музыкально-драматический театр имени. Вот он:

Информация о владельцах офшорной ФорексБРОзарегистрированной в недоступна, однако совсем несложно узнать, кто является учредителем ООО «ФорексБРО ». Согласно данным ЕГРЮЛ учредителями ООО «ФорексБРО » являются ( доля в уставном фонде 112 млн ? или 99%) и офшорная ФорексБРО(доля в уставном фонде 970,1 тыс ? или 1%). Зачем было устраивать эту клоунаду с неуклюжими попытками убедить общественность в непричастности Кравченка к сомнительным схемам развода клиентов в офшорном ФорексБРО, можно только догадываться.
